KUALA LUMPUR, April 1 — Communications Minister Datuk Fahmi Fadzil said that decisions to prosecute individuals suspected of breaking the law, including cases involving drunk drivers, fall under the authority of the Attorney General, with investigations guided by existing legal frameworks and evidence.
He said the Royal Malaysia Police (PDRM) conduct inquiries not only under road transport laws but also on broader legal grounds when sufficient evidence exists to justify prosecution.
“The Cabinet did not specifically discuss this matter today, as prosecution proceedings were ongoing during the meeting. It may be reviewed next week.
“Since the case is active, we respect the process. For now, the actions are based on existing law concerning murder charges.
“The matter will proceed according to the Attorney General’s office regarding legal aspects,” he said during the ministry’s weekly press conference here today.
Earlier today, a 28-year-old man was formally charged in Klang Magistrate’s Court with the murder of a motorcyclist following a fatal collision last Sunday.
He was found to be under the influence of both alcohol and drugs at the time of the crash.
Saktygaanapathy Ravichandran faces a charge under Section 302 of the Penal Code for the death of 33-year-old motorcyclist Amirul Hafiz Omar.
If convicted, the offence carries the mandatory death penalty, or alternatively, a prison term of between 30 and 40 years, along with a minimum of 12 strokes of the cane.
