
PUTRAJAYA, May 20 — The Federal Court here today upheld the 30-year prison sentence and 16 strokes of the cane imposed on a Ukrainian national for trafficking 24.753 kg of methamphetamine four years ago.
A three-member bench comprising Justices Datuk Rhodzariah Bujang, Datuk Lee Swee Seng and Datuk Ravinthran N. Paramaguru dismissed the appeal filed by Akahimo (also known as Akanimo) against his conviction and sentence.
According to the charge sheet, Akahimo, 48, a former nightclub manager, committed the offence at the car park of a restaurant at Jalan C180/1, Dataran C180/1, Batu 11, Hulu Langat, Selangor at 6 pm on May 24, 2022. He was initially charged with three other persons, but they were acquitted by the High Court.
On June 26, 2024, the High Court found Akahimo guilty and sentenced him to 30 years in prison with 16 strokes of the cane.
The court ordered the sentence to take effect from the date of his arrest on May 24, 2022. This ruling was subsequently upheld by the Court of Appeal on June 19, last year.
According to the facts of the case, a narcotics team from the Selangor Police Contingent Headquarters was conducting surveillance when they saw a Mercedes-Benz arrive at the location, shortly followed by a Toyota Vios.
Both vehicles then pulled up close to each other. The appellant exited the Mercedes-Benz and proceeded towards a nearby Proton Bezza car.
The driver of the Mercedes-Benz allegedly lowered the vehicle window and used a remote-control device to unlock the Perodua Bezza.
Police officers then observed Akahimo exiting the Mercedes-Benz and proceeding to the Proton Bezza, from which he retrieved a brown box.
Consequently, the team moved in and apprehended all the accused despite their attempt to flee. An inspection of the box revealed packages of Chinese tea labelled “Guanyinwang”, each containing a plastic bag filled with substances suspected to be drugs.
At the proceedings today, deputy public prosecutors Iznina Hanim Hashim and Siti Rafidah Zainuddin appeared for the prosecution, while lawyer Sivahnanthan Ragava represented Akahimo. — Bernama
