SHAH ALAM, Sept 14 — A 15 year old boy was today acquitted of murdering his 16 year old schoolmate at a secondary school in Bandar Utama last year, after the High Court found he was of unsound mind at the time of the offence.
According to Berita Harian, Judge Adlin Abdul Majid ordered the teenager to be detained and undergo treatment at Hospital Bahagia Ulu Kinta in Perak, with the consent of the Sultan of Selangor.
The boy’s lawyer, Kitson Foong, told reporters after the closed door proceedings that the court accepted the defence’s argument under Section 84 of the Penal Code, which provides for acquittal on grounds of unsoundness of mind. He said the defence had successfully proven the condition, while the prosecution failed to rebut it.
